Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and SumDay ("we", "us", "our") regarding your use of the iOS application SumDay: Daily Budget Planner (the "App"). By downloading, installing, opening, or using the App you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Your use of the App is also subject to Apple's App Store terms and usage rules that apply to apps distributed through the App Store.

If you are using the App on behalf of an entity, you represent that you are authorised to bind it.

You must be at least the age of digital consent in your jurisdiction (16 in most of the EU, 13 in the United States, 16 in the UK; check your local law). If you are under 18 you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

The App is not intended for children under 13 (or under 16 in the EEA/UK).

We grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use one copy of the App on Apple devices that you own or control, solely for your personal, non-commercial use, and only as permitted by Apple's "Usage Rules" for the App Store and these Terms.

You agree not to:

• copy, modify, translate, reverse-engineer, decompile, disassemble, or attempt to derive source code from the App, except where this restriction is prohibited by applicable law;
• rent, lease, lend, sell, redistribute or sublicense the App;
• circumvent, disable or interfere with security or abuse-prevention features;
• abuse the AI features (e.g. automation, scripts, scraping, mass-uploading of unrelated images, attempts to extract the underlying model or training data);
• upload or transmit content that is illegal, infringing, defamatory, harassing, or that contains malware;
• use the App to compete with us or to build a similar product;
• use the App in violation of export controls, sanctions or other applicable law.

We may suspend or terminate your access if you violate these restrictions.

The App offers auto-renewable subscriptions ("Premium") that unlock specific features. Available subscription options, billing periods, prices, trial availability if any, and renewal terms are shown in the App Store purchase sheet or in-app paywall before you confirm a purchase.

Auto-renewal.Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the period ends. Your Apple ID will be charged for renewal within 24 hours of the period's end.

Trials and promotions. If a free trial, introductory price or promotional offer is available, the App Store will show the applicable terms before you confirm. If you do not cancel before the end of a trial or promotional period, it may convert into a paid subscription as disclosed by the App Store.

Cancellation. Manage or cancel any time in iPhone → Settings → [your name] → Subscriptions, or in the App Store app → your profile → Subscriptions. Uninstalling the App alone does not cancel a subscription.

Payment. All payments are processed by Apple. We do not see, store or process your payment card.

Refunds.All refund requests are handled by Apple under Apple's policies. Statutory rights — including the EU 14-day right of withdrawal under the Consumer Rights Directive (subject to its consumption / digital-content exceptions) and any equivalent under Ukrainian consumer law — are not affected.

Price changes.If we change subscription prices, we will give you advance notice through the App or App Store as required by Apple's rules. You can cancel before the new price takes effect.

A free version of the App is provided "as is" with limited functionality. We may add or remove features in either tier at any time.

The App is a personal-budgeting tool. It is not:

• a regulated financial-advice service,
• an investment, tax, accounting, legal, debt-counselling or insurance service,
• a banking or payment service,
• a product subject to MiFID II, the Investment Advisers Act, or comparable regulation.

Calculations are based on the numbers you type in. We make no representation that they are mathematically correct in every edge case, that they reflect your actual financial situation, or that following the daily limit will improve your finances. Always verify with a qualified professional before making decisions. You are solely responsible for your financial decisions and outcomes.

The App uses third-party generative AI for:

• Receipt scanning — extracting amount, merchant and category from a receipt photo;
• Weekly insights — generating a short text comment on aggregated weekly spending.

By using these features you acknowledge and accept that:

1. AI output is probabilistic and may be wrong. Receipt scanning may misread amounts, dates, merchants or categories.
2. You must verify every AI result before saving. Saving extracted values is your decision and your responsibility.
3. AI features may be unavailable. They depend on third-party services, network connectivity, our paid quota and abuse prevention. We may disable them temporarily or permanently without notice and without refund.
4. Receipt images are sent to a third-party AI provider. See the Privacy Policy, Section 3.3.
5. Aggregated weekly numbers are sent to a third-party AI provider (Section 3.4 of the Privacy Policy). No transactions or notes are sent.
6. No professional advice. AI-generated text is not financial, legal, tax, medical or psychological advice.
7. No guarantee of accuracy, completeness, reliability, or fitness for purpose of any AI output. AI features are provided as is and as available.
8. Hallucinations. The model may produce outputs that look plausible but are factually incorrect. We disclaim all liability for losses caused by reliance on AI output.

If you do not accept these terms for AI features, do not use them — the rest of the App works without them.

The App integrates SDKs from Apple, Google (Firebase), RevenueCat and Mixpanel. Their terms and privacy policies apply to your use of those services. We are not responsible for their availability or behaviour.

You retain ownership of the data you enter into the App (transactions, notes, categories, photos). You grant us a worldwide, royalty-free, limited license to process that data only as needed to provide and improve the App, and only as described in the Privacy Policy.

You are solely responsible for the accuracy, legality and backup of the data you enter. We do not back up your data to our servers; if you uninstall the App, your local data may be irretrievable.

You represent that you have the right to upload any image you submit to receipt scanning and that doing so does not violate anyone's rights.

All rights, title and interest in and to the App, its source code, designs, trademarks (including "SumDay"), copy, animations, art, brand assets and documentation belong to us or our licensors. Nothing in these Terms transfers any IP to you.

Feedback you send us about the App is non-confidential and may be used by us without restriction.

To the maximum extent permitted by law, the App and all features (including AI) are provided "AS IS" and "AS AVAILABLE", with all faults and without any warranty of any kind — whether express, implied, statutory or otherwise — including, without limitation, implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, available in your country, compatible with your device, or that any defects will be corrected.

Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions only, the above exclusions apply only to the maximum extent permitted by law and do not affect your statutory rights as a consumer.

To the maximum extent permitted by law:

• No indirect damages. We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost data, or any damages resulting from inaccurate AI output.
• No payment beyond the App purchase. To the extent liability cannot be excluded under applicable law, our total cumulative liability is limited to the amount you paid for the App or subscription through the App Store in the 12 months before the event.
• No liability for AI errors. We are not liable for any decision you make based on AI-generated content.
• No liability for financial outcomes. We are not liable for budgeting outcomes, debt, missed bills, bank fees, currency conversion losses, or other financial consequences.
• No liability for data loss. Back up your device.
• No liability for third parties. We are not liable for failures of Apple, Google, RevenueCat, Mixpanel, your carrier, the App Store, the network, or any other third party.

Mandatory law. Nothing in these Terms excludes or limits liability for fraud, gross negligence, intentional misconduct, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.

We may modify, suspend, restrict access to or discontinue the App (or any feature, including AI features) at any time, with or without notice, and without liability.

We may terminate your right to use the App immediately if you breach these Terms or use the App in a way that creates risk for us or other users. Sections that by their nature should survive termination remain in effect.

We may roll out beta or experimental features. Such features may be unstable and may be changed or removed without notice or refund.

Subject to your local consumer-protection rights, these Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles.

For consumers domiciled in the EU/EEA, UK, or another jurisdiction whose mandatory consumer-protection law would otherwise apply: nothing in this Section deprives you of the protection of the law of your country of habitual residence.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right.

These Terms, together with the Privacy Policy, App Store terms that apply to your download or purchase, and any policies referenced from within the App, are the entire agreement between you and us regarding the App and supersede all prior agreements.

We may update these Terms. Material changes will be announced in-app or in App Store release notes. The "Effective date" reflects the latest version. Continued use of the App after the effective date constitutes acceptance to the extent your local law allows; otherwise we will request fresh consent.
